TERMS AND CONDITIONS

Welcome to Equipsupply Ltd. These Terms and Conditions together with our privacy policy govern our relationship with you. The terms “Company”, or “us” or “we” refer to Equipsupply Ltd throughout this document. The term Buyer(s) shall refer to the person(s), firm or company who purchase items from us, Equipsupply Ltd.

Acceptance of Order: All orders shall be deemed to be an offer by the Buyer to purchase goods in accordance with these conditions. Any order received from a Buyer by the Company shall only constitute a contract after the Company has confirmed in writing that the ordered goods have been dispatched. To this extent the standard acknowledgement of the receipt of an order (which shall be sent as a matter of course) shall not constitute a contract. The Company reserves the right to refuse an order even after the order confirmation email has been sent, should the need arise. It is the Buyers responsibility to ensure that the order, the terms of the order and any applicable specification are complete and correct.

Prices: The Company reserves the right to make adjustments to prices if necessary due to currency fluctuations; raw material or factory price increases. Buyers will be made aware of any changes in prices as soon as possible. Please note changes to prices will not be made after a monetary transaction has occurred. All prices stated on product description pages are exclusive of value added tax and delivery costs. Prices inclusive of VAT and delivery costs will be clearly stated at the checkout stage prior to completion of order. Any quotation is valid for a period of 30 days only from its date, provided that the Company has not previously withdrawn it.

Delivery: Delivery for most products is free anywhere up to and including Glasgow going north and anywhere on the mainland going south. Delivery of some items beyond Glasgow ill incur a charge as will delivery to anywhere off of the mainland. Customers will be notified of any additional cost in advance of delivery and will be given the option of cancelling the purchase should they with not to proceed.

All periods and dates are given in good faith and are not part of any warranty or condition.  Equipsupply Ltd will however strive to meet delivery dates as given on the dispatch confirmation notice or at the very least within 30 days of dispatch confirmation, as required in Distance Selling Regulations 2000. All products are subject to availability and any dates specified by the Company are intended to be an estimate.

If buyers do not receive their goods within 10 days of dispatch confirmation they should let the Company know in writing.

In addition buyers should examine all products upon receipt. Any shortage or damage should be noted on the delivery note that will come back to Equipsupply with the driver. This will allow the Company to rectify the order immediately.

Non-acceptance of Delivery: If for any reason the Buyer will not accept delivery of any goods when they are ready, or the company is unable to deliver the Goods on time because the Buyer has not provided appropriate instructions, documents, licences or authorisations, the goods will be deemed to have been delivered and the company may store the goods until delivery whereupon the buyer will be liable for all related costs and expenses (including without limitation, storage and insurance).

Description of Goods: A description of all goods will appear on Equipsupply Ltd’s website. All drawings, descriptive matter, specifications and advertising issued by the Company and any descriptions or illustrations contained on the website are issued for the purpose of giving an approximate idea of the goods. They will not form part of the contract.

Returns/Exchanges/Cancellations: Buyers wishing to cancel a contract for any reason may do so in writing within 7 working days of receiving goods. A full refund (minus postage/delivery costs) for the cancelled contract will be given within 30 days of receiving cancellation notice, provided that goods are in full re-saleable condition.

Returns should be made within 30 days of receipt and should be in their original packaging. Returned items may be subject to a restocking fee and/or administration charge.

Payment: All payments must be received in full prior to dispatch of goods. No payment shall be considered “received”, until the Company has received cleared funds.

Unforeseen Circumstances: The Company will not be liable for any delays or any failure to perform (as applied to goods) that occur due to unforeseen circumstances including but not limited to Acts of God, adverse weather conditions, flood, fire, industrial action, act of government, war, riot, terrorism or actions of any party for whom the Company is not directly responsible.

Warranty: The Company warrants that all goods supplied by it will correspond to their specification and will be free from defects for a minimum of 12 months (some goods carry longer warranties – e.g. Sanyo microwaves). In the event of a breach of this contract the Company will repair/replace the item in question after it has been returned to the Company provided that:

1. The claim has been made in writing within the warranty period.
2. The defect or failure of the product arose from wilful damage/misuse, negligence by the customer or a third party, failure to follow the Company’s instructions, or alteration/repair of the goods without the Company’s prior approval.

All warranties are subject to Buyers carrying out adequate maintenance and servicing of equipment. Failure to do so will render any warranties void.
